Review the terms, conditions, and legal guidelines governing your access to and use of the InsightsPulse website, portal, and embedded reporting services.

1. Introduction

InsightsPulse is a Software-as-a-Service (“SaaS”) platform for embedding, managing, and securely sharing Power BI, Tableau, and other supported analytics dashboards through a fully branded, white-label analytics portal. These Terms and Conditions (“Terms”) govern access to and use of the InsightsPulse website at https://insightspulse.in/ and all related services (collectively, the “Services”). By accessing or using the Services, you agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use the Services.

2. Definitions

  • “Platform” means the InsightsPulse white-label analytics portal, website, and related applications and APIs.
  • “Customer” means the organization that registers for and subscribes to the Services.
  • “User” means any individual authorized by a Customer or Organization to access the Platform.
  • “Organization” means the Customer entity and its associated administrators and Users.
  • “Dashboard” means any Power BI, Tableau, or other supported report or visualization embedded through the Platform.
  • “White-Label Portal” means the branded analytics portal made available to a Customer under its own domain, logo, and branding.
  • “Subscription” means the Customer’s paid or trial access to the Services under a selected plan.
  • “Services” means the InsightsPulse embedded analytics platform, white-label portal, and associated features described on https://insightspulse.in/.

3. Acceptance of Terms

By creating an account, starting a free trial, subscribing to a paid plan, or otherwise accessing or using the Services, the Customer and its Users confirm their acceptance of these Terms. Continued access to or use of the Services following any update to these Terms constitutes acceptance of the revised Terms.

4. Eligibility

Users must be legally capable of entering into a binding contract under applicable law and, where accessing the Platform on behalf of an Organization, must be duly authorized to act on that Organization’s behalf and to bind it to these Terms. InsightsPulse reserves the right to refuse service or terminate accounts where eligibility requirements are not met.

5. User Accounts

Users are responsible for maintaining the confidentiality of their account login credentials and for all activity that occurs under their account. Users must notify InsightsPulse promptly of any unauthorized access to, or use of, their account. InsightsPulse is not liable for any loss or damage arising from a User’s failure to safeguard their login credentials.

6. Organization Accounts

Organization administrators are responsible for managing Users within their Organization’s account, assigning appropriate permissions and access levels, maintaining accurate billing information, and ensuring that all Users comply with these Terms and applicable law when using the Platform.

7. Subscription Plans

InsightsPulse offers three Subscription plans, as published on https://insightspulse.in/Pricing:

  • the Basic plan (USD 8 per user, per month)
  • the Professional plan (USD 349 per month, supporting up to 50 users, and including white-label branding and custom color themes)
  • the Enterprise plan (USD 599 per month, supporting up to 100 users, with comprehensive security management and white-labeling options).

Features, user limits, and pricing may be changed by InsightsPulse from time to time, with prior notice provided to existing Customers before any change takes effect on their Subscription.

8. Free Trial

InsightsPulse offers a free trial period of fifteen (15) days, allowing access for up to five (5) users to basic Power BI and Tableau report dashboards, with no credit card required to sign up. Trial features may be limited compared to paid plans. InsightsPulse reserves the right to modify the duration or scope of the free trial at its discretion.

9. Payments & Billing

Paid Subscriptions renew automatically according to the selected Billing Cycle unless cancelled by the Customer prior to the renewal date, in accordance with the InsightsPulse Refund & Cancellation Policy. By subscribing, the Customer authorizes InsightsPulse to charge the applicable fees to the payment method on file. Failed payments may result in restricted access, suspension, or termination of the Subscription following reasonable notice.

10. Taxes

All fees quoted for the Services are exclusive of applicable taxes unless stated otherwise. The Customer is responsible for payment of all applicable taxes, including Goods and Services Tax (GST) for Customers based in India, or equivalent taxes in the Customer’s jurisdiction, unless InsightsPulse is required by law to collect and remit such taxes directly.

11. License Grant

Subject to the Customer’s compliance with these Terms and timely payment of applicable fees, InsightsPulse grants the Customer a limited, non-exclusive, non-transferable, and revocable license to access and use the Services during the term of the Subscription, solely for the Customer’s internal business purposes and for sharing dashboards with its authorized Users and end viewers.

12. Acceptable Use

Users must not reverse engineer, decompile, or attempt to extract the source code of the Platform; scrape, crawl, or extract data from the Platform except as permitted through authorized APIs; abuse, overload, or attempt to circumvent API rate limits or security controls; upload, embed, or transmit malicious code, viruses, or harmful content; or otherwise misuse the Platform in a manner that could damage, disable, or impair InsightsPulse’s systems or the experience of other Users.

13. White-Label Services

Customers may customize the InsightsPulse portal with their own approved branding assets, including logo, color themes, and custom domain, in accordance with the features available under their Subscription plan. Customers remain solely responsible for ensuring that all branding materials, logos, and content they upload do not infringe the intellectual property rights of any third party and comply with applicable law.

14. Power BI & Tableau Integration

The Platform enables Customers to embed and share Power BI and Tableau dashboards through the white-label portal. Customers retain full ownership of their underlying dashboards and data. Use of Power BI and Tableau content through the Platform remains subject to the respective licensing terms of Microsoft and Tableau (Salesforce), and Customers are responsible for maintaining any required creator or administrator licenses for those platforms.

15. Customer Data Ownership

Customers retain full ownership of all data, dashboards, and reports uploaded to or connected through the Platform (“Customer Data”). InsightsPulse processes Customer Data solely to deliver the Services, including rendering and securely distributing embedded dashboards, and does not claim any ownership rights over Customer Data.

16. Intellectual Property

All software, source code, documentation, trademarks, logos, and underlying platform technology that comprise the InsightsPulse Services remain the exclusive property of InsightsPulse or its licensors. Nothing in these Terms transfers any intellectual property rights in the Platform to the Customer, other than the limited license expressly granted under Section 11.

17. Confidential Information

Both InsightsPulse and the Customer agree to use reasonable care to protect any confidential business information disclosed by the other party during the course of their relationship, and to use such confidential information solely for purposes related to the provision and use of the Services, except where disclosure is required by law.

18. Data Security

InsightsPulse implements commercially reasonable technical and organizational safeguards to protect Customer Data, including encryption of data in transit, role-based access control (RBAC), secure authentication, and continuous monitoring and activity logging, consistent with the practices described in the InsightsPulse Privacy Policy.

19. Third-Party Services

The Platform may integrate with, or rely upon, third-party service providers, including cloud hosting providers, Microsoft Power BI, Tableau, authentication providers, and payment gateway providers. Such third-party providers remain subject to their own respective terms of service and privacy policies, and InsightsPulse is not responsible for the acts or omissions of independent third-party providers.

20. API Usage

Where InsightsPulse provides API access, Customers and Users must keep all API keys and credentials confidential and secure. API keys must not be shared, publicly exposed, or used in a manner that exceeds the usage limits associated with the Customer’s Subscription plan. InsightsPulse reserves the right to suspend API access in the event of misuse.

21. Service Availability

InsightsPulse will use reasonable efforts to keep the Platform available and operational; however, the Services may occasionally be unavailable due to scheduled maintenance, updates, or circumstances beyond InsightsPulse’s reasonable control. InsightsPulse will endeavour to provide advance notice of planned maintenance windows where practicable.

22. Support Services

InsightsPulse provides customer support through the channels listed on its Contact page, including phone and email. The scope, priority, and response times for support requests may vary depending on the Customer’s subscribed plan (Basic, Professional, or Enterprise), with Enterprise Customers generally receiving prioritized support.

23. Disclaimer of Warranties

The Services are provided on an “AS IS” and “AS AVAILABLE” basis, without warranties of any kind, whether express or implied, to the maximum extent permitted by applicable law. InsightsPulse does not warrant that the Services will be uninterrupted, error-free, or completely secure, or that they will meet every specific requirement of the Customer.

24. Limitation of Liability

To the maximum extent permitted by applicable law, InsightsPulse’s aggregate liability arising out of or relating to these Terms or the Services shall not exceed the total subscription fees paid by the Customer to InsightsPulse in the twelve (12) months immediately preceding the event giving rise to the claim. In no event shall InsightsPulse be liable for indirect, incidental, special, or consequential damages, including loss of profits or data, arising from the use of the Services.

25. Indemnification

The Customer agrees to indemnify and hold InsightsPulse harmless from and against any claims, damages, liabilities, and reasonable expenses arising out of the Customer’s or its Users’ misuse of the Services, breach of these Terms, or violation of applicable law or third-party rights.

26. Suspension

InsightsPulse may suspend a Customer’s or User’s access to the Services, in whole or in part, in the event of non-payment of fees, suspected fraud, abuse of the Platform, or reasonable security concerns, and will endeavour to provide notice of such suspension where practicable, except where immediate suspension is necessary to protect the security or integrity of the Platform.

27. Termination

Either party may terminate the Subscription in accordance with these Terms and the InsightsPulse Refund & Cancellation Policy. Upon termination, the Customer’s access to the Services will cease, and any provisions of these Terms that by their nature should survive termination (including intellectual property, confidentiality, indemnification, and limitation of liability provisions) shall continue to apply.

28. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law principles. The courts located in New Delhi, India shall have exclusive jurisdiction to resolve any dispute arising out of or relating to these Terms, subject to any mandatory consumer protection laws that may apply in the Customer’s jurisdiction.

29. Force Majeure

Neither party shall be liable for any delay or failure to perform its obligations under these Terms to the extent such delay or failure results from causes beyond its reasonable control, including natural disasters, internet or telecommunications failures, government action, or other events of force majeure.

30. Changes to Terms

InsightsPulse may update these Terms from time to time to reflect changes in its Services, business practices, or applicable law. Where changes are material, InsightsPulse will provide reasonable notice, such as by updating the “Last Updated” date at the top of these Terms or notifying Customers via email. Continued use of the Services following such changes constitutes acceptance of the updated Terms.
